1. GENERAL

The following terms and conditions ("Terms") apply when you, as a consumer (hereinafter referred to as "customer" or "you"), place an order at www.rowicohome.com (hereinafter referred to as "rowicohome.com" or "Site") and associated pages. By purchasing on our Site, an agreement is established between you as a customer and Rowico AB, 556152-9271 ("Rowico", "we", "us"). 2. PROCESSING OF PERSONAL DATA

Orders on Rowicohome.com may only be placed by individuals who are at least 18 years old. Individuals under 18 require parental or guardian approval.

5. ORDERS & AGREEMENT

These Terms apply to all purchases made on rowicohome.com by customers residing in the countries where we offer sales and shipping within the EU. For purchases from other countries, please refer to our resellers in the respective country. By placing an order, you agree to these Terms, and an agreement is established when you receive an order confirmation. Please note that it is not possible to change the delivery address after placing an order.

 

6. PRICES & FEES

Prices are displayed in Euro (€) for shipments within the European Union, Swedish kronor (SEK) for shipments to Sweden, Danish kronor (DKK) for shipments to Denmark, including VAT, unless stated otherwise.

We also reserve the right for any 'typographical errors' in product information and possible out-of-stock situations that may result in the product being unavailable for delivery. Rowico may cancel or refuse your order if the price is obviously incorrect and you, as a consumer, should have reasonably understood this. Shipping costs and any applicable fees are added during checkout. We reserve the right to correct errors, adjust prices, and modify product information.

 

7. PAYMENT

We collaborate with Klarna Bank AB (publ) to provide various payment options, including credit or debit card, invoice, and installment plans. Available payment methods may vary depending on the country of purchase, and local deviations may apply. The available options will be displayed at checkout. 8. CANCELLATION

We strive to process and ship your order as quickly as possible. Therefore, it is only possible to cancel your order until 08:00 CET on the next working day after placing the order. To cancel, email contact@rowico.com with your order number.

 

9. DELIVERY

At checkout, our products are displayed along with an estimated delivery time. If you place an order containing multiple items with different delivery times, all items will be shipped together once all products have arrived at our warehouse. In this regard, the delivery time is determined by the product with the longest delivery time.

Ordered goods are shipped either as parcels or via a shipping provider, depending on the size and weight. The shipping costs for your order will be specified at checkout before you confirm your purchase.

For deliveries made by a shipping provider, you will be required to provide a phone number where you can be contacted to arrange a delivery date. Either we or our transport partner will contact you via phone before delivery to schedule a time. If the delivery location is inaccessible by truck or difficult to reach, you are obligated to inform us in advance. If this information is omitted, you will be responsible for any additional costs incurred as a result. If the delivery cannot be completed due to such circumstances, it will be considered as if you failed to receive the goods on time.

Rowico generally offers home delivery via a shipping provider to the property boundary/curbside or parcel delivery to pick-up points. For certain postal codes, in-home delivery using standard furniture transport is available for an additional fee. If this option is available for your address, you can select it at checkout. The costs will be specified at checkout.

If a parcel or freight item cannot be delivered or handed over to the customer and the customer is responsible for the failure, the customer must bear the cost of returning the item to us. Additionally, we reserve the right to cancel the purchase agreement immediately if the ordered goods cannot be delivered, in which case we will refund the purchase price received.

We do not deliver to certain islands or remote territories, for example, the Faroe Islands and Greenland. If a shipping address is unavailable for selection during checkout, delivery to that location is not supported.

ASSEMBLY

Assembly is not included in our delivery options.

DELIVERY DELAYS

We at Rowico monitor all orders. If a delivery delay occurs, we will notify you via email as soon as possible. 

Rowico is not responsible for the impossibility of delivery or for delivery delays caused by force majeure or other unforeseeable events (e.g., operational disruptions of any kind, strikes, lockouts, shortages of labour, energy, or raw materials, changes in legislation, war, fires, sabotage, floods, incorrect or late deliveries from suppliers) for which we are not responsible. The delivery time shall be extended in accordance with the duration of such actions and obstacles. 
Rowico has the right to cancel the contract if the goods cannot be delivered by the manufacturer (e.g., in cases of manufacturer insolvency) or if there are other obstacles to fulfilment that could not be foreseen when the contract was concluded, and which cannot be overcome through reasonable efforts on our part despite attempts to procure similar goods elsewhere. In the event of cancellation, we will immediately inform you that the purchased goods are unavailable. Any payments already made will be refunded to you immediately in such cases.

 

10.  TRANSPORT DAMAGE

We ask you to check the goods for damage and defects immediately upon receipt. In the event of transport damage, you should always report the damage immediately to us using our claims form. To ensure a smooth claims process, we kindly ask you to report any transport damage within 7 days of receiving the goods. Failure to report the damage immediately will not affect your legal claims.

Please note that goods may have both visible and hidden transport damage. If the goods or packaging are damaged, or if a parcel is missing, this must be noted on the carrier’s delivery note upon receipt and signed by both you and the carrier.

 

11. RIGHT OF WITHDRAWAL  

We always strive for you to be satisfied with your order. However, if you are not, you have the right to withdraw from this contract within fourteen (14) days without providing any reason. The withdrawal period is fourteen (14) days from the day you or a third party designated by you, who is not the carrier, takes possession of the goods.

To return a product and exercise your right of withdrawal, you need to complete our return form. You may also use the standard withdrawal form provided by the relevant consumer authority.

To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction unless otherwise expressly agreed; in no case will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have provided evidence of having sent back the goods, whichever occurs first.

You must return or hand over the goods to us immediately and in any event no later than fourteen (14) days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen (14) days has expired.

For goods that can be returned via parcel service, you bear the direct costs of returning the goods in the amount of €29 (except Denmark where the fee is 195 DKK). Goods that cannot be returned via parcel service (freight goods) will be collected from you. You bear the direct costs of returning goods that cannot be sent via parcel service in the amount of €89 (except Austria, where the fee is €99, and Denmark where the fee is 595 DKK).

You will only be liable for any diminished value of the goods if this loss of value results from handling the goods beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for which an individual selection or determination by the customer is decisive or which are clearly tailored to the personal needs of the customer (hereinafter referred to as "custom-made goods"). Custom-made goods are considered to be those products that have been modified using a configurator available on the Site before placing the order. 

 

12. COMPLAINTS

When you receive your order, it is important that you carefully inspect the items. If you discover that the product(s) are damaged or do not meet your expectations, please report this to our customer service using our claims form. 
As a customer, you have a two-year statutory warranty on all our products in accordance with EU consumer protection laws. This warranty covers defects in the products you have purchased from us. If you discover a defect, you must report it as soon as possible. Your complaint must be made within a reasonable time after you noticed or should have noticed the defect.

To file a complaint, please complete our claims form. In the form, specify the reason for the complaint and provide a detailed description of the issue. Attach photos clearly showing both the product and the defect, along with your contact details, order number, and product article number. Rowico will then contact you regarding the next steps.

When you file a complaint and we determine that your claim is valid, we will primarily seek to rectify the defect. If that is not possible, we will provide you with a replacement product. If neither of these options is feasible, we will offer you a reasonable price reduction.

We strive to implement one of these measures within 30 days from the date we receive your complaint. However, depending on the product in question, processing times may take longer.

We cover the return shipping cost for approved complaints. If we send out a replacement product, Rowico will cover the shipping cost to your property boundary. If we require a product to be returned, we will send you a return shipping label. Once you receive the label, you must contact designated shipping provider to schedule a pickup. If we do not require the defective product to be returned, you may keep it at no additional cost.

 

13. OTHER INFORMATION  

We would like to draw your attention to the fact that the colour rendering on your computer screen may cause the shade of our products to differ slightly from the actual shade of the product.

Photographs published on Rowicohome.com are protected by copyright and have different rights holders. If you wish to use these images in other contexts, please contact us.

 

14.  CHANGES TO TERMS

Rowico reserves the right to make changes and updates to these Terms and Conditions. In this regard, the Terms and Conditions that apply at the time of purchase shall be valid.

 

15. LIABILITY

Claims for damages from the customer are excluded. Exceptions to this are claims for damages by the customer resulting from injury to life, body, or health or from the violation of essential contractual obligations (cardinal obligations), as well as liability for other damages based on an intentional or grossly negligent breach of duty by us, our legal representatives, or agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.

In the event of a breach of essential contractual obligations, Rowico shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless the customer’s claims for damages are based on injury to life, body, or health.

The above limitations of liability also apply in favor of our legal representatives and agents if claims are asserted directly against them.

The above limitations of liability do not apply if the defect has been fraudulently concealed or if a guarantee for the properties of the goods has been assumed. The same applies if the customer and we have reached an agreement on the properties of the goods. Product liability remains unaffected by this.

Furthermore, Rowico is not liable for damages resulting from the use of (or inability to use) electronic means of communication in connection with this Site, including, but not limited to, damages caused by errors or delays in the transmission of electronic communication, interception or manipulation of electronic communication by third parties, or computer programs used for electronic communication and the transmission of viruses.

 

16. FORCE MAJEURE

Rowico is not responsible for circumstances beyond our control. Such circumstances include government intervention, new or amended legislation, war, fires, floods, work stoppages, bans, restrictions, sabotage, poor transport and weather conditions, failure of deliveries from suppliers, or if Rowico or our partners are affected by criminal activity.

 

17. DISPUTE RESOLUTION

We strive to resolve disputes amicably. If a resolution cannot be reached, you may contact the European Commission’s Online Dispute Resolution (ODR) platform: https://ec.europa.eu/odr.

These Terms are governed by Swedish law, and disputes are resolved in Swedish courts. However, if the laws of your country of residence provide stronger consumer protection rights than Swedish law, those rights shall apply.
